TCPA compliance & consent

KMA takes Telephone Consumer Protection Act (TCPA) compliance extremely seriously. All outbound calling campaigns conducted by KMA on behalf of our clients adhere to the following standards:

Prior express written consent

All consumer data used in our outbound campaigns is sourced exclusively from individuals who have provided prior express written consent to be contacted by telephone, including by autodialer or prerecorded message, for the relevant product or service category. We maintain records of consent for all data used in our campaigns.

Do Not Call compliance

KMA maintains active subscriptions to the National Do Not Call Registry and applicable state do-not-call lists. Consumer data is scrubbed against these registries prior to use in any outbound campaign. We also honor company-specific do-not-call requests immediately upon receipt.

Calling time restrictions

All outbound calls are placed only between 8:00 AM and 9:00 PM in the consumer's local time zone, in accordance with TCPA requirements.

Identification requirements

Our agents identify themselves, the company on whose behalf they are calling, and provide a contact number at the beginning of each call, in compliance with FTC Telemarketing Sales Rule requirements.

Opt-out requests: If you wish to be removed from any calling list associated with KMA's campaigns, you may request removal at any time by calling 833-820-8033 or emailing info@keymarketingagency.com. All opt-out requests are processed within 30 days.

Data sharing & disclosure

We do not sell your personal information to third parties for their own independent marketing or advertising purposes. We may share information in the following limited circumstances:

With our clients

When we conduct campaigns on behalf of business clients, qualified consumer information is transferred to those clients as part of the live transfer or lead delivery service. Such transfers are made pursuant to our client agreements and only to the extent necessary to fulfill the service.

With service providers

We work with trusted third-party vendors who assist us in operating our business, including telecommunications providers, CRM and software platforms, data verification services, and cloud infrastructure providers. These vendors are contractually obligated to protect your information and may only use it to perform services on our behalf.

  • Website inquiry and contact form submissions are retained for up to 3 years
  • Campaign performance data may be retained indefinitely in aggregated, de-identified form

When personal information is no longer needed, we securely delete or anonymize it in accordance with our data disposal procedures.
